Terms of Service

This Terms of Service agreement ("Agreement") governs your use of the Max Delta 6 intelligence reports and related communications provided by Perdurable Capital, Inc., an Arizona corporation ("Company"). By subscribing to and using these reports, you ("Subscriber") acknowledge and agree to be legally bound by the terms and conditions set forth herein.


1. Nature of Services Provided

Perdurable Capital, Inc. provides periodic newsletters and market intelligence updates derived from its proprietary Max Delta 6 analytics engine. These updates (the "Reports") may include but are not limited to: summaries of market signals, academic insights, and commentary based on real-time derivatives market data.

Subscribers do not receive access to the Max Delta 6 dashboard or software application itself, which remains the sole and exclusive intellectual property of Perdurable Capital, Inc.


2. Disclaimer of Financial Advice and Risk Acknowledgment

The Reports are for informational and educational purposes only. They are not intended to constitute investment, legal, tax, accounting, or financial advice, nor are they a solicitation or recommendation to buy or sell any securities, options, or other financial instruments.

Trading involves substantial risk and is not suitable for all investors. By subscribing, you expressly acknowledge and agree that:

  • You are solely responsible for your own trading decisions.

  • The Company does not guarantee the accuracy, completeness, or timeliness of any information in the Reports.

  • Past performance is not indicative of future results.

Under no circumstances shall Perdurable Capital, Inc., its principals, officers, directors, employees, agents, contractors, affiliates, successors, heirs, or assigns ("Released Parties") be held liable for any loss or damage—including without limitation, direct, indirect, incidental, special, punitive, or consequential losses—arising from your use of, reliance on, or inability to use the Reports.


3. Subscription Terms

Subscribers pay a recurring fee (the "Subscription Fee") in exchange for access to the Reports. The Company reserves the right to modify, suspend, or terminate the Reports at any time for any reason without notice or liability.

  • No Refunds. All Subscription Fees are final and non-refundable. Refunds may be issued solely at the discretion of Perdurable Capital, Inc., on a case-by-case basis.

  • The Company may refuse service or terminate any subscription at its sole discretion.


4. Proprietary Rights

All Reports and any intellectual property therein, including all methodologies, analyses, data compilations, visualizations, textual content, and formatting, are and shall remain the exclusive property of Perdurable Capital, Inc. You agree not to:

  • Reproduce, distribute, or share the Reports in any form without express written consent;

  • Reverse engineer, decompile, or extract any part of the proprietary analytics engine;

  • Use the Reports to create derivative works or competing products/services.


5. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses (including attorneys’ fees and costs) arising out of or in any way connected with your breach of this Agreement or your use of the Reports.


6. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with:

  • The laws of the United States of America, and

  • The laws of the State of Arizona, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona for the resolution of any disputes arising from or related to this Agreement.


7. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.


8. Entire Agreement

This Agreement constitutes the entire understanding between you and the Company regarding your subscription and use of the Reports. It supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.


9. Modifications

Perdurable Capital, Inc. reserves the right to update or revise this Agreement at any time. Continued use of the Reports after such modifications constitutes acceptance of the revised terms.


If you do not agree to these terms, you may not use the Reports.
